Plain answers about plans, trusts and guardianship

Fees

What does the first call cost?

Nothing. It is thirty minutes, by phone, and you are under no obligation afterward.

Why a flat fee for documents?

So you never hesitate to call with a question while the drafts are open. The fee is set in writing after the planning meeting.

How do I pay?

Half when you sign the engagement letter, half at the signing. Court work is billed monthly against the estimate.

Plans

We moved here from another state. Is our old will still good?

Often it still works, but powers of attorney and health care papers may not be honored the way you expect. I review out-of-state plans for a small flat fee.

Who should I name as executor?

Someone organized who answers their mail. They do not have to live nearby, and they can hire help.

Do you handle probate?

I help the families of my own clients through it. For other probate matters I refer you to colleagues I trust.

Trusts

Can a special needs trust pay for housing?

It can, though it may reduce some benefits. I explain the trade-off with your child's own benefits in front of us.

Guardianship

Do I need guardianship if Dad already signed a power of attorney?

Usually not. A good power of attorney is often the reason a family never needs court.
